I am directed by Secretary Sir John Simon to
invite reference to the Colonial Office letter No. 92685/32
of the 5th December 1932 enclosing copy of a despatch from
the Officer Administering the Government of Hong Kong
conveying an explanation by the Registrar of the Supreme
Court there that certain documents issued by the High
Court of Justice at Tehran for service upon a person
named Agha Mohamed Ali could not be served on him unless
accompanied by a letter of request from the Persian court
concerned.

I am to enclose for the information of Secretary
Sir Philip Cunliffe-Lister copy of a note which has now
been received from the Persian Chargé d'Affaires returning
the documents for service upon Agha Mohamed Ali and
explaining that it is not the practice of the Persian
Courts to issue formal letters of request where the service
of writs is desired.

In view of the fact that the service of process
from foreign tribunals is constantly effected in this
country through the High Court of Justice without insisting
upon the production of a letter of request for service,

notwithstanding that the terms of the relevant Rule of
Court (Order XI Rule 9) are similar to those of the
corresponding rule in force in Hong Kong which are cited
in the enclosure in your above-mentioned letter, I am to
express the hope that Sir Philip Cunliffe-Lister may see
his way to return the accompanying documents to Hong Kong
with an intimation that they should now be served on the
person for whom they are intended without requiring the
production of the letter of request which the rules
contemplate.
